At Taza Township
HOW HOME OWNERSHIP WORKS AT TAZA: WHAT BUYERS NEED TO KNOW
The Partnership holds a long-term prepaid lease that extends to 2114, allowing leaseholders to own their property and improvements while funding their land lease(s) in full upfront.
Under this model, the Crown on behalf of the Tsuut’ina Nation retains land ownership while granting to the Partnership a long term head lease, who then subleases to developers, who then sublease or assign their subleases to homeowners. Homeowners are responsible for standard utilities, taxes, and condo fees where applicable.
Currently at Taza, there are home ownership options with and without condo fees which will determine the documents received for conveyancing.
Whether you’re buying a home directly from the builder (first purchaser) or planning a resale or refinancing of a home at Taza – here is what you need to know about the documents required.

UNDERSTANDING THE REGISTRY (ILRS)
In Alberta, the Alberta Land Titles System is commonly used to record ownership and surveys. However, at Taza, leasehold interests are recorded within the Indian Lands Registry System (ILRS), and surveys are registered within the Canada Lands Survey Records (CLSR). The ILRS is a federal system that records interests in reserve lands administered under the Indian Act.
The ILRS registry creates a Parcel Abstract Report (PAR) with a unique Parcel Identification Number (PIN) for each home in Taza. A Sublease, Assignment and Assumption Agreement, and any applicable encumbrances—such as mortgages, easements, or non-disturbance agreements—are registered on that PAR.
You will require a Parcel Abstract Report if you are reselling or refinancing at Taza. To obtain your PAR you will need your full property legal details which can be found below. Once you have your property details, you can obtain your PAR by accessing the Indian Lands Registry System.

HOMEOWNER CONDO CORPORATIONS
When purchasing a home with condo fees, you will be a member of a Homeowner Condo Corporation, incorporated under the Canada Not-for-Profit Corporations Act. These corporations function similarly to condominium corporations under the Condominium Property Act and are responsible for:
- Maintaining and managing common property
- Enforcing condo bylaws and community rules
- Managing budgets, financial statements, meetings, and governance
Once the builder has sold over half of the units within their project, control transfers to the homeowners.
Homeowners’ Lawyers may request a Condo Estoppel Certificate, commonly required when selling. Certificates are available through the builder (or their legal counsel) or through the condo’s property management firm once they are established.
SUPPORTING LEGAL DOCUMENTS YOU MIGHT NEED
To support the purchase, sale, or refinancing of homes within Taza several legal documents may be required. If you are a first-time buyer in Taza who has purchased from a residential home builder, request these documents from your builder’s lawyer. If your transaction is a resale or you are refinancing, there is a submission process to finalize the conveyancing that provides you with the documents listed below.
1. Lessor Mortgage Agreement
Provides lenders with assurances regarding the assignment and assumption of Residential or Homeowner Leases, defaults, and mortgage enforcement rights.
2. Crown Non-Disturbance Agreement
An agreement among the Crown, the Partnership, the Nation, and the purchaser. It confirms the Crown’s recognition of the lease assignment and provides assurances that the lease will not be disturbed during the term.
3. Partnership Non-Disturbance Agreement
Applicable only for condo-style developments. It confirms the Partnership’s recognition of the Homeowner Lease and its commitment not to disturb the lease during the term.
4. Partnership's Lender's Non-Disturbance Agreement
An agreement between the Partnership’s lender and the purchaser(s) assuring that, even if enforcement occurs against the Head Lease, each of the leases held by the homeowners remain in effect.
5. Crown Estoppel Certificate
A certificate confirming that the Head Lease is in good standing.

STEP BY STEP PROCESS
STEP 1: GATHER REQUIRED DOCUMENTS
- Ensure you have your Parcel Abstract Report
- Ensure you have your purchase agreement
- Ensure you have the purchaser’s mortgage informations
STEP 2: Complete the Request Form
Whether a client is buying a resale, selling their home, or refinancing their existing home in Taza, lawyers are required to complete the submission form on this page with all relevant information. For resales, the lawyer for the seller or purchaser can request the forms, but please only submit one request per transaction.
STEP 3: Submit the Form and Payment
Fill out the form fields below. Closing fees are required to complete the transaction and will be paid directly to McMillan. Closing fees for Taza are $275.00 plus GST. Payment invoices will be provided by McMillan LLP and due upon receipt.
All fees listed are current at the time of publication and are based on a standard conveyancing transaction. Final fees may vary depending on the complexity of the transaction, third-party costs, additional legal requirements, or changes in scope – fees may be adjusted accordingly.
STEP 4: Receive the Documents
Once a submission form is received, McMillan LLP will generate and provide the requesting lawyer with PDF copies of the Documents with the necessary executed signature pages (generally McMillan LLP will generate these documents within two (2) business days of the request), which are releasable upon McMillan receiving the fully executed documents and payment.
STEP 5: Return Fully Signed Documents
The requesting lawyer to provide PDF copies of the fully executed documents to McMillan LLP within 30 days post-closing.

1. Eligibility to Use This Portal
